BH Web Services, LLC (“BHWS,” “we,” or “us”) respects the privacy of its users and visitors. This Privacy Policy explains our privacy practices for information we gather through bernieportal.com (the “Site”) and through our products and services, including our online HR platform, BerniePortal (together, the “Services”).

The Services help employers and brokers manage and administer HR and group health insurance plans, so users include employers, their employees, and the employer’s support providers, all of whom log in through the Site.

Information We Collect

When you visit the Site or use the Services, we may collect information such as website usage, traffic patterns, and performance statistics using the tracking technologies below, sometimes with the help of third-party service providers. This information can help us offer a more personalized experience.

IP addresses. Our web server may record your computer’s IP address, browser and operating system information, the date and time of access, and the page that linked you to the Site or Services. We use this to diagnose server problems and improve the Site and Services.

• Marital status
• Details of employment with your current employer
• Benefits information
• Name and age of any dependents covered under benefits
• Your answers to questionnaires

It may be disclosed to your employer and to third-party employer support providers (brokers, reinsurers, health insurance providers, payroll processors, and similar) only as directed by your employer or that provider.

How We Protect Your Information

We have security measures in place designed to mitigate risk, using reasonable, appropriate, and customary procedures and technologies to protect the confidentiality of personal information, and we periodically review and update our practices.

That said, no website or online service can be completely protected against intentional or malicious intrusion. We don’t control the devices, computers, or networks you use to send us information, so we can’t prevent potential interception or compromise while it’s in transit, and we can’t guarantee the security, integrity, or confidentiality of information transmitted to or from the Site or Services. We’re committed to safeguarding your information to the best of our ability, but we can’t guarantee absolute security over the internet.

Children’s Privacy

Our Site doesn’t intentionally collect personal information from, or market to, children under 13. If you believe we have information from the Site about a child under 13, please let us know so we can remove it. The one exception: users of the Services may provide and save information about minors under 13 where it’s needed to administer health insurance coverage for an employee’s dependents.

“BH Web Services,” “BerniePortal,” and the associated logos, content, and design on the Site and in the Services are protected by U.S. copyright and trademark law. You may not copy, reproduce, republish, upload, post, display, transmit, or frame any of these materials without the prior written consent of the owner, and no rights to these materials pass to you as a user or visitor.

Disclaimer of Warranties

Except as expressly warranted in a separate agreement you may have with us, the Site, Services, and any other materials, software, or information we provide are offered “as is” and “with all faults,” without warranties of any kind, express, implied, statutory, or otherwise. We specifically disclaim all implied warranties, including merchantability, non-infringement, and fitness for a particular purpose, to the maximum extent the law allows.

Limitation of Liability

If you have a separate agreement with us covering the Services, our liability is limited as described there. Otherwise, we won’t be liable to you for anything arising from your use of the Site, Services, or related materials, whether in contract, tort (including negligence), or under any other theory — including any lost profits or indirect, special, incidental, punitive, or consequential damages, however caused, even if we’ve been advised of the possibility of such damages. This disclaimer doesn’t apply to the extent prohibited by law.
